Terms of Service

1. About BuildVault and These Terms

BuildVault is a scale-modeling hobby product and related promotional website provided by BLG Studios LLC ("BLG Studios," "we," "us," or "our"). These Terms of Service ("Terms") describe conditions for accessing the promotional website at getbuildvault.com and related support services. The BuildVault Android and iOS applications remain in development and limited testing, and are not yet generally available to the public.

Provisions concerning mobile-app accounts, modeling records, and app functionality apply to app users when these Terms are validly presented and accepted for that use. Publishing these Terms on the website does not, by itself, establish that any existing tester accepted them or make them retroactively binding. "Service" refers to the website, support services, and, where these Terms validly apply, the mobile application.

2. Agreement to the Terms and Privacy Policy

You may browse the promotional website without creating a BuildVault account. When using the website or contacting support, please use those services lawfully and follow the applicable rules below. These Terms are intended to govern website use only to the extent they are lawfully presented and binding in the circumstances; website browsing alone is not treated here as proof of affirmative acceptance of mobile-app Terms.

If the mobile application presents these Terms through an affirmative acceptance process, choosing to accept them constitutes agreement for that app use to the extent enforceable under applicable law. If you do not agree, do not create an account or use the account-based features governed by them.

Our Privacy Policy, available at getbuildvault.com/privacy, explains how we collect, use, disclose, and retain personal information in connection with the public website and the mobile app during limited testing. These Terms govern use of the Service; the Privacy Policy describes our information practices. Where they address the same issue differently, the Privacy Policy controls the description of personal-information practices, except where applicable law requires otherwise.

3. Eligibility and Younger Users

BuildVault is intended for people 13 years of age or older. Children under 13 must not register for a BuildVault account or submit personal information through the Service.

If you are 13 through 17, we encourage you to review these Terms with a parent or legal guardian. Where applicable law requires parental or guardian permission for your use of the Service, that permission is required. We may review or restrict an account if we learn that its use is inconsistent with applicable age-related requirements.

The initial BuildVault mobile-app launch is intended for the United States. Planned availability in other countries will be evaluated separately.

4. Accounts and Account Security

The promotional website does not provide BuildVault app account registration. For authorized users of the mobile-app testing experience, account-based features currently use an email address, password, and display name. Where these Terms apply to your account, you agree to provide accurate registration information, keep your credentials confidential, and take reasonable steps to protect access to your account. You are responsible for activity conducted through your account to the extent permitted by applicable law.

Please contact support@getbuildvault.com if you believe your account has been compromised or used without authorization. Account confirmation, password recovery, and session management depend on the authentication features made available in the current application.

You may not impersonate another person, knowingly provide false information about your eligibility, or access another person's account without authorization.

5. What the Service Provides

The public promotional website introduces BuildVault and offers support contact options; it does not itself provide the mobile app's account-based modeling tools. The mobile app is designed to help hobbyists organize and document scale-modeling activities. In limited testing, depending on the application version, available features may include Builds, Stash records, Wishlist items, bench sessions, recipes, kit information, notes, and project photographs.

Some features described in product plans or development materials—including club workspaces, public sharing, barcode scanning, expanded notifications, and paid subscriptions—may be unavailable. Their inclusion in a roadmap or demonstration is not a promise that they are presently offered or will become available on a specific date.

BuildVault is a personal hobby-management tool, not a professional valuation, insurance, inventory-auditing, or archival guarantee.

6. Your Modeling Records and Other Content

You retain whatever ownership, copyright, and other rights you hold in the original photographs, notes, project descriptions, and other content that you submit to BuildVault ("Your Content"). Using BuildVault does not transfer ownership of Your Content to BLG Studios LLC.

When you submit Your Content through an account-based feature governed by these Terms, you grant BLG Studios LLC a limited, nonexclusive, royalty-free license to host, store, copy, process, back up, and display Your Content to you or another person you authorize through an available Service feature, solely as reasonably necessary to operate, maintain, secure, and support that feature. This includes permitting contracted infrastructure providers to process Your Content on our behalf for those purposes.

This operational license does not authorize public promotion of Your Content, use of Your Content in our advertising, or use of Your Content to train AI models. A materially different use would require an appropriate separate authorization or updated agreement as applicable.

The operational license lasts only as needed for these purposes, including any lawful or technically necessary retention described in the Privacy Policy. Deleting a record from the visible application may not immediately remove all stored copies. No automatic permanent-erasure deadline is promised by this license.

You remain responsible for deciding what information to include in Your Content and for having lawful grounds to submit it. Rights belonging to model manufacturers, artists, photographers, or other third parties remain theirs.

7. Photographs and Private Content

Modeling records and uploaded photographs are private by default in the currently assessed BuildVault experience; there is no current public photo gallery. We may introduce optional collaboration or sharing features in the future, subject to appropriate changes to the Service and disclosures.

Photographs may contain embedded metadata, including timestamps, device information, or location information. BuildVault does not guarantee that metadata is removed before upload. Avoid uploading photographs or notes containing information you do not want stored with your account.

You must have the necessary rights or other lawful permission to upload photographs and other content. You must not use the Service to infringe another person's copyright, privacy, or other legal rights.

8. Acceptable Use

You agree not to:

• Use the Service for unlawful activity or in a way that infringes another person's rights.
• Gain or attempt to gain unauthorized access to accounts, systems, or data.
• Disrupt, overload, probe, or interfere with the security or normal operation of the Service.
• Use automated scraping, abusive requests, spam, or other methods that unreasonably burden the Service.
• Upload malicious code or content that is illegal, exploitative, or otherwise prohibited by applicable law.
• Reverse engineer or bypass technical safeguards except where applicable law expressly permits it.

These rules apply to the current hobby-management Service. They do not imply that BuildVault currently operates a marketplace, social network, or public content-moderation system.

9. BuildVault Intellectual Property and Permission to Use the Service

BLG Studios LLC and its licensors retain their rights in the BuildVault application, website, software, interface, design, logos, documentation, and branding. These Terms do not transfer ownership of those materials to you.

Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable permission to access and use the Service for lawful purposes. You may not reproduce, resell, or commercially exploit BuildVault's software or branding without permission, except as applicable law allows.

References to model manufacturers, products, or other third-party brands do not imply sponsorship or endorsement. Nothing in these Terms claims that the BuildVault name or logo is a registered trademark.

10. Privacy and Third-Party Services

We use third-party services to provide infrastructure, authentication, storage, email delivery, website hosting, and security functions. These may include Supabase, Cloudflare, Resend, Google Workspace, and the app-development or distribution services relevant to a particular app release. Our Privacy Policy describes personal-information processing in greater detail.

We do not sell personal information or share it for cross-context behavioral advertising as part of our current BuildVault business practices. If our practices materially change, we will review the relevant disclosures and legal obligations before implementing those changes.

Third-party platforms through which you obtain an app may impose their own applicable download or distribution terms. Those terms are separate from these Service Terms where applicable.

11. Availability, Updates, and Data Preservation

The promotional website provides information and support contact options, while the mobile application remains under active development and limited testing. Features may change, be temporarily interrupted, or become unavailable due to maintenance, security issues, technical failures, or changes to outside services.

We do not promise uninterrupted access, an uptime percentage, or that every feature will remain available indefinitely. We may modify or discontinue features, giving notice when required by applicable law.

Although BuildVault is designed to help preserve modeling records, it is not a guaranteed permanent archive. You should maintain separate copies of photographs or information that you cannot afford to lose, where practical.

12. Fees and Future Paid Features

The currently assessed BuildVault application does not offer an active user-facing subscription checkout or paid-plan purchase flow. These Terms do not establish subscription prices, trial periods, refund schedules, or recurring charges.

We may offer paid features in the future. Before doing so, we will provide applicable pricing, billing, cancellation, and refund information and update the relevant terms and disclosures as needed. Any future purchases may also be subject to the rules of the applicable app store or payment provider.

13. Account Restrictions and Termination

We may restrict or suspend access where reasonably necessary to respond to suspected unauthorized access, security threats, serious violations of these Terms, unlawful activity, or failure to satisfy eligibility requirements. We may also stop providing the Service, subject to applicable notice and consumer-protection requirements.

Where reasonable and lawful, we will seek to provide notice or an opportunity to address a concern. Immediate protective action may be necessary in some security or safety situations. A restriction or suspension does not itself mean that all account information or related content has been permanently deleted.

14. Removing Records and Requesting Account Deletion

Certain BuildVault features allow you to remove individual modeling records or photographs from the ordinary application view. Some of these actions use soft deletion, and removal from the interface does not necessarily mean immediate erasure from every stored system or backup.

Complete self-service account deletion is not yet operational in the currently assessed mobile application. Removing individual records is not the same as deleting an account and its associated information. The promotional website does not create mobile-app accounts and does not currently offer an account-deletion portal.

During this development stage, you can contact support@getbuildvault.com for questions about account information, correction, and available deletion options. We will address applicable privacy-rights requests in accordance with the law. The Privacy Policy provides additional information about retention and requests.

15. Disclaimers

BuildVault is a hobby organization and documentation tool. It does not provide professional, financial, appraisal, insurance, safety, or legal advice. Information about products, projects, or supplies may be incomplete or inaccurate and should be independently checked where important.

To the extent permitted by applicable law, the Service is provided on an "as available" and "as is" basis, without promises of continuous operation or error-free performance. Nothing in these Terms excludes warranties or statutory rights that cannot lawfully be excluded, including rights that may apply to consumers or minors.

16. Limitations of Liability

To the extent permitted by applicable law, BLG Studios LLC will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Service, including loss of profits or loss of data, where such exclusions are legally permitted.

Nothing in these Terms limits liability for conduct or legal rights that cannot lawfully be limited or excluded.

17. Governing Law and Disputes

Subject to applicable mandatory consumer-protection laws, these Terms are intended to be governed by the laws of the State of Indiana, United States, without applying conflict-of-law rules that would require another jurisdiction's laws.

Unless applicable law requires or permits another forum, disputes relating to these Terms would be brought before courts of competent jurisdiction in Indiana. Nothing here takes away rights to bring a claim in another forum where applicable law prohibits that restriction.

18. Changes to These Terms

We may update these Terms as the Service develops, as legal requirements change, or as new features become available. An updated version will display its effective date. We will provide additional notice or seek affirmative acceptance when required by law or when appropriate for material changes.

Any updated Terms apply according to their stated effective date and applicable law; publishing an update does not by itself establish that a user consented where consent is required.

19. Geographic Availability

BuildVault's initial mobile-app release is intended for the United States. The public website may be accessible elsewhere, and access from a particular country does not guarantee local app availability or support.

Before expanding the intended mobile-app availability internationally, we plan to review applicable legal, privacy, and operational requirements. Nothing in these Terms removes rights that mandatory local law gives you.
